1. Application of the general conditions of sale

These general conditions of sale apply to all our sales of equipment and services. By placing an order on IMPRESSION.NC, you accept our general conditions of sale. IMPRESSION.NC reserves the right to modify these conditions at any time. In the case of a closed transaction, the conditions on the date indicated on the invoice are applied. No special conditions can, unless formal written acceptance on our part, prevail over our general conditions of sale. Any contrary condition posed by the buyer will therefore be unenforceable against us in the absence of express acceptance on our part. The fact that we do not take advantage, at any time whatsoever, of any of these general conditions of sale cannot be interpreted as a waiver of the right to subsequently take advantage of any of the said conditions.

2. Order

Automatic recording systems are considered as proof of the nature, content and date of the order. LA FABRIK confirms acceptance of its order to the customer at the e-mail address that the customer has communicated. The information provided by the buyer when taking the order binds the buyer: in the event of an error in the wording of the recipient's contact details, the seller will not be held responsible for the impossibility of delivering the product. The sale will only be concluded upon confirmation of the order and validation of payment. LA FABRIK reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order. The language proposed for the conclusion of the contract is French. You can consult your order history at any time in your customer account.

3. Payment

The price invoiced to the customer is the price indicated when validating the order sent by LA FABRIK. In accordance with the provisions of the Civil Code on the conclusion of online contracts, the contract will be concluded when you click on the button allowing you to confirm your order after having viewed the details of it and in particular its total price and having had the opportunity to correct any errors. You will thus recognize your payment obligation. Items are shipped once payment has been received by LA FABRIK.

The following payment methods are available to you to pay for purchases made on our site:

  • Bank Card (VISA, MasterCard, Carte Bleue, American Express, Maestro): The entire order process is in HTTPS (secure protocol). We work with a company specializing in securing online payments. All sensitive data is transmitted via an SSL encrypted page. Your payment will be debited immediately after validation of the order.
  • Bank transfer: Transfer your payment to us by bank transfer. Your order will be processed as soon as we receive your payment. (Often within 1 business day, max. 3 business days).
  • Bank check: Payment by bank check is unfortunately not accepted due to too many unpaid bills.

4. Price

IMPRESSION.NC guarantees that the price mentioned when validating the order. All prices on the site are indicated excluding tax (HT). The TGC amount is added at the time of validation of the order.

6. Order cancellation

When the goods are "personalized" you do not have the possibility of benefiting from your right to modify or cancel your order in accordance with article L121-20-2 of the Consumer Code. This is because as soon as we receive your order, the manufacturing process begins immediately and the products are made to your exact specifications.

In the event that an item cannot be delivered, in the event of a stock problem, the purchase contract may be canceled if a solution in agreement with both parties cannot be found.

7. Photos - Technical sheets

All photos representing the products on IMPRESSION.NC are taken as precisely as possible. However, an item may vary slightly from the images shown on our website. IMPRESSION.NC cannot be held responsible for differences between the images displayed and the actual product.

8. Delivery

IMPRESSION.NC works in collaboration with Caledonian carriers for these deliveries. These carriers may be required to use subcontractors to carry out delivery. The products available on the site can only be delivered to New Caledonia.

You will be informed by email of the dispatch of your order on the day it is sent.

The place of delivery is the address given to IMPRESSION.NC by the customer. Please ensure you fill in your address correctly. If your address is not filled in correctly, and the order cannot be delivered, IMPRESSION.NC cannot be held responsible.

IMPRESSION.NC aims to keep all items mentioned on our site in stock and to deliver them within the time frame you choose.

IMPRESSION.NC will execute accepted orders promptly but no later than 30 days, unless another delivery time has been agreed. If delivery is delayed, or if an order cannot be fulfilled or can only be partially fulfilled, you will be informed no later than 30 days after placing the order. In this specific case, you have the right to terminate the contract free of charge, and to request possible compensation.

9. Requirements for content and printed products

At IMPRESSION.NC, we respect the right to freedom of expression, that is to say the possibility of having opinions and receiving or sharing information and ideas without any interference. However, it is important to understand that this right comes with certain responsibilities and limitations and must be respected at all times. This is why we have developed a “content policy”, which is a direct reflection of our culture, values ​​and beliefs.

IMPRESSION.NC customers are free to print whatever they want, as long as it does not contravene our principles. This means that IMPRESSION.NC reserves the right, at any time, to refuse or cancel any order, if the content downloaded by the customer directly or indirectly:

Violates the (intellectual property) rights of third parties;

- Is contrary to any law and/or regulation;

- Involves harming or exploiting children

- Expresses itself in a manner that is harassing, abusive, racially or ethnically offensive, defamatory, invasive of privacy or publicity rights, or threatening;

- Discriminates based on race, religion, gender, sexual orientation, age, disability, ancestry, national origin or any other criterion;

- Displays any symbol prohibited by state law, federal law, national law, or local law, or that is commonly associated with groups or systems of oppression, or symbols of hatred or disrespect, as well as symbols commonly and historically associated with discriminatory groups or movements, or which are associated with crime, hatred or violence;

- Involves the sale or promotion of illegal or fraudulent activities, products or services;

- Contains links to material related to any of the content prohibited in our policy.

We decline any collaboration with customers whose beliefs or values ​​are contrary to our policy.

In the event that IMPRESSION.NC decides to refuse or cancel an order based on the above rights, the customer will be informed and reimbursed up to the amount of the order. IMPRESSION.NC will in no way be responsible for the refusal or cancellation of an order and will no longer contact the customer.

10. Withdrawal

10.1 When the goods are "personalized" you do not have the possibility of benefiting from your right of withdrawal, modifying or canceling your order, returning the goods or requesting a refund. This is because as soon as we receive your finalized order (payment received and files approved), the manufacturing process begins immediately and the products are manufactured to your exact specifications. Therefore, in accordance with article L121-20-2 of the Consumer Code, the conditions of article 9.2 do not apply in this case. Claims must be made within 14 days of delivery of the order.

For the withdrawal period to be respected, it is sufficient for you to send your communication relating to the exercise of the right of withdrawal before the expiration of the withdrawal period. You must return the goods without undue delay and, in any event, no later than 14 days after you communicate your complaint to us regarding this contract. This deadline is deemed to be respected if you return the goods before the expiry of the fourteen day period. The costs of returning the goods are our responsibility. The package must be dropped off by you at a collection point.

In the event of a complaint from you, we will reimburse you for all payments received from you, including delivery costs (except for additional costs arising from the fact that you have chosen, where applicable, a different delivery method). than the less expensive method of standard delivery offered by us) provided that the return of the items is made without undue delay and, in any event, no later than 14 days from the expression of your complaint. We will make the reimbursement using the same means of payment that you used for the initial transaction, unless you expressly agree to a different means; in any case, this reimbursement will not incur any costs for you. We may defer reimbursement until we have received the goods or until you have provided proof of dispatch of the goods, whichever date is the earlier of these events.

To conclude, you have 14 days from receipt of your order to express a complaint about your order. In the event of a return, you have 14 days from the expression of your complaint to return the items to us according to the specifications of our customer service.

11. Warranty

IMPRESSION.NC guarantees that all items delivered meet the requirements required by existing Caledonian regulations and regulations.

12. Confidentiality

Personal data will only be recorded if you have stipulated that you wish to remain informed of our offers, our new products and other information from IMPRESSION.NC. 13. Grant of jurisdiction

Contracts concluded on our website (data relating to your order and General Terms and Conditions in force on the day of your order) are archived for a period of 5 years. You can access archived contracts by requesting them by email to contact@la-fabrik.nc or by post.

Any contract, as well as any order accepted by us, is governed by Caledonian law. The courts have sole jurisdiction when the co‐contractors have the status of merchant even in the event of incidental claims, warranty claims and/or even cases of multiple defendants. The various methods of shipping or payment, our provisions or acceptances of payment, as well as the place of delivery, cannot operate either novation or derogation from this jurisdiction clause. In this case, the consumer can initiate proceedings in addition to the place where the defendant resides, with the jurisdiction of the place of delivery.
